Stall foreclosure by asking the lender for a copy of the original note.

I recently read an article in the San Francisco Chronicle that talked about a women in Florida.  Apparently she had asked her lender to provide her with a copy of the ‘Note’ they were foreclosing on.  Turns out the Lender couldn’t find one.  With all the servicing transfers, loan packaging and bank buyouts, it’s not surprising.

When this woman found that out, she told her attorney who then filed documents with the court.  This put the foreclosure on ‘hold’ and she has not heard back from the bank in over six months.  While this may not work for everyone, it is a way to stall foreclosure proceedings long enough to give you time to take advantage of the newly passed Obama loan modification options.
